City of Oak Grove, PD Named in Federal Lawsuit

The City of Oak Grove, its police department, and two officers have been named defendants in a federal lawsuit alleging false arrest from an incident in April of last year.

Christopher Green originally filed the lawsuit in Christian County Circuit Court but it was moved to the Western Division of Federal Court earlier this month.

According to the lawsuit, which represents just one side of the issue, Green was at the pilot Truck Stop in Oak Grove on April 8 of last year. Oak Grove Police were called to the scene to investigate a possible drug overdose. The suit alleges that Oak Grove Officer Danielle Adams arrested Green in the front of his vehicle for violation of an emergency or domestic violence protective order.

Green says there was an order but it did allow him to have contact with the petitioner, Tabitha Smith. Green went on to say that he spent four hours in the Christian County Jail and lost his job as a result of the arrest.

The lawsuit alleges false imprisonment and arrest, unreasonable search and seizure, emotional distress, and negligence on the part of the police department.

Oak Grove Police Chief Dennis Cunningham is also named in the suit with the legal action claiming he and the department were negligent by failing to properly train or supervise Adams in how to properly respond and evaluate drivers suspected of being under the influence and how to properly check the National Crime Information Computer for protective order conditions.

Green is seeking compensatory and punitive damages as well as lost wages.
